PART II — RIGHTS, LIBERTIES, AND DEMOCRATIC GUARANTEES

Section 1. Fundamental Human Dignity
1. Human dignity is inherent and inviolable.  
2. The State shall respect, protect, and fulfill the dignity of every person without exception.  
3. No law or government action may diminish or infringe upon this principle.

Section 2. Equality and Non‑Discrimination
1. All persons are equal before the law and entitled to equal protection and equal benefit of the law.  
2. Discrimination on the basis of race, color, ethnicity, national origin, gender, sex, sexual orientation, gender identity or expression, disability, age, religion, political belief, socioeconomic status, or immigration status is prohibited.  
3. The State shall take affirmative measures to eliminate systemic inequality and historical injustice.

Section 3. Personal Liberty and Security
1. Every person has the right to life, liberty, and personal security.  
2. No person shall be subjected to arbitrary arrest, detention, or surveillance.  
3. Torture, cruel or degrading treatment, and coercive interrogation are prohibited without exception.  
4. Habeas corpus shall be guaranteed at all times, including during emergencies.

Section 4. Privacy and Digital Rights
1. Every person has the right to privacy in their home, communications, data, and digital identity.  
2. Personal data belongs to the individual; its collection, storage, and use require informed consent.  
3. Mass surveillance without individualized judicial authorization is prohibited.  
4. Individuals have the right to access, correct, delete, and transfer their personal data.  
5. Algorithms used by the State must be transparent, auditable, and free from discriminatory bias.

Section 5. Freedom of Expression, Press, and Information
1. Every person has the right to freedom of expression, speech, and artistic creation.  
2. A free, independent, and diverse press is essential to democracy and shall be protected.  
3. The State shall ensure public access to accurate information and safeguard against censorship.  
4. Whistleblowers exposing wrongdoing, corruption, or threats to public welfare are protected.

Section 6. Freedom of Assembly, Association, and Participation
1. People have the right to peaceful assembly, protest, and collective action.  
2. Workers have the right to organize, unionize, and bargain collectively.  
3. No person shall be penalized for participating in democratic or civic activities.  
4. Political participation shall be free from intimidation, coercion, or economic retaliation.

Section 7. Democratic Integrity and Voting Rights
1. Voting is a fundamental right and civic duty.  
2. Elections shall be free, fair, accessible, and publicly funded.  
3. Voter suppression in any form is prohibited.  
4. Districts shall be drawn by an independent, nonpartisan commission.  
5. Citizens have the right to direct democracy mechanisms including initiatives, referenda, and recall elections.

Section 8. Economic and Social Rights
1. Every person has the right to adequate housing, nutritious food, clean water, and essential utilities.  
2. Healthcare is a universal right; the State shall ensure equitable access to comprehensive care.  
3. Education from early childhood through higher education or vocational training shall be publicly funded and accessible.  
4. Every person has the right to meaningful employment, fair wages, safe working conditions, and protection from exploitation.  
5. No person shall live in poverty in a nation of abundance; the State shall ensure a basic standard of living.

Section 9. Environmental and Climate Rights
1. Every person has the right to a clean, healthy, and sustainable environment.  
2. The State shall protect ecosystems, biodiversity, and natural resources for present and future generations.  
3. Climate policy shall be guided by scientific consensus and the principle of intergenerational justice.  
4. Communities disproportionately affected by environmental harm shall receive priority protection and remediation.

Section 10. Indigenous Sovereignty and Rights
1. Indigenous nations possess inherent sovereignty and the right to self‑governance.  
2. Their lands, cultures, languages, and traditions shall be protected and revitalized.  
3. The State shall honor treaties, ensure free, prior, and informed consent, and provide restitution for historical injustices.

Section 11. Family, Identity, and Bodily Autonomy
1. Every person has the right to bodily autonomy, including reproductive freedom and gender self‑determination.  
2. Families, in all their diverse forms, are entitled to protection and support.  
3. Marriage is a civil institution open to all consenting adults.

Section 12. Justice, Due Process, and Fair Treatment
1. Every person has the right to a fair, impartial, and timely trial.  
2. Public defenders shall be adequately funded and independent.  
3. Excessive bail, fines, and sentences are prohibited.  
4. The justice system shall prioritize rehabilitation, restorative justice, and community safety over punishment.  
5. The death penalty is abolished.

Section 13. Rights of Future Generations
1. The State shall act as a steward for future generations, ensuring that long‑term well‑being is not sacrificed for short‑term gain.  
2. Policies must consider ecological, economic, and social sustainability across generations.

Section 14. Enforcement and Justiciability
1. All rights in this Part are fully enforceable in courts of law.  
2. The State bears the burden of proving any limitation on rights is necessary, proportionate, and consistent with democratic values.  
3. No emergency, war, or crisis may suspend the core rights enumerated in Sections 1
